We reserve the right to modify our pricing, terms and conditions at any time without notice.

"Funl" in this text is shorthand for "Funl Events, Inc.".

Funl Bidders

Funl reserves the right to terminate your access at anytime with or without cause, with or without notice, effective immediately.

The experiences sold on the Funl website are provided "as is". Funl and its members and licensors hereby disclaim warranties of any kind, express or implied, including, without limitation, warranties of merchantability, warranties of experiences not including what was presented in an experience's Funl event page, use for a particular purpose and non- infringement.

Neither Funl nor its members or licensors, make any warranty that the site will be error free or that access will be continuous or uninterrupted.

You understand that you interact and obtain services through the site at your own discretion and risk.

The integrity and the experience rendered of an experience described/presented in a Funl is solely the responsibility of the Funl Creator and not Funl Events, Inc.

By agreeing to these terms, you agree to indemnify and hold harmless Funl Events, Inc., its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorney fees, arising out of your use of the site, arising out of an experience where you dispute the experience rendered versus the experience described/presented in that experience's Funl, the content posted by any Funl Creator, the content posted by any Funl user, and including but not limited to your violation of these terms.

Funl is not responsible for any conflicts due to internet browser compatibility, internet outage, or third party systems used in the Funl platform.

Funl member services will be supported for the duration of the active membership.

Services with annual recurring plans will be supported for the duration of the active service subscription.

All sales are final. There are no refunds.

We rely on bidders paying the full price of their winning bid. The Bid Winners ticket revenue allows the Funl Creator to pay for expenses related to their Funl.

You must have a card-on-file in your account in order to win a Funl. If you are in the winning group but do not have a card-on-file, your bid will be removed 24 hours prior to the Funl closing. You will have until the Funl closes to add a card-on-file and re-submit your bid.

When a Funl closes, Bid Winners will have their card-on-file auto-charged for their ticket.

If the card-on-file fails, or does not have sufficient funds, Bid Winners will have 48 hours to fully pay for their winning bid. After 48 hours, their ticket may be offered to the next highest bidder outside of the Bid Winners.

You may cancel your bid in a Funl prior to the Funl closing. If you cancel your bid more than 3 times, your access to that particular Funl will be under review and may result in your access terminated to that particular Funl.

If you cancel more than 3 times in more than 3 Funls, your Funl account will be under review and may result in termination.

If you win a Funl, and do not pay for your ticket, your Funl account will be under review and may result in termination.

If you win a Funl, pay for your ticket, but submit a dispute with your payment provider, your Funl account will be under review and may result in termination.

When you enter your email on our website, you are automatically added to our mailing list to receive updates about that specific Funl, other Funls we determine you may be interested in, regular news and special offers.

By agreeing to the terms, you elect to opt-in to future communication from the Funl team related to its products, services and best practice help. You may choose to opt-out of receiving this communication at anytime.

Funl reserves the right to terminate your access at anytime with or without cause, with or without notice, effective immediately.

After creating your Funl, your Funl will enter our approval process. All Funls must be approved before bidding can take place. Our approval process takes 1-2 business days.

If a Funl is not approved, the Funl Creator owes nothing to Funl.

Upon completion of bidding for a Funl (Funl Closing), the Funl Creator will pay Funl 10% of the sum of the Bid Winners ticket gross bid amounts before any taxes, any fees, and any expenses.

For example, if a Funl ends with 20 tickets being sold for $500 per ticket, the Funl Creator will pay Funl $1,000 (10% of $10,000).

Funl offers a Concierge service to help brainstorm, create and run your Funl, as well as attend your Funl to ensure it's a successful event. This service is optional.

If a Funl Creator uses Funl's Concierge service for their Funl, the Funl Creator will pay an additional 10% to Funl plus any travel costs for Funl employee(s) to attend and run your event.

For example, if a Funl ends with 20 tickets being sold for $500 per ticket, the Funl Creator will pay Funl $1,000 (10% of $10,000). If the Funl Creator used Funl's Concierge service for this Funl, the Funl Creator will pay an additional $1,000 (10% of $10,000) to Funl.

We use Stripe and Stripe's invoicing service to collect payment from Funl Winners. The Funl Creator pays Stripe's card fee (2.9% plus $.30 per transaction) and Stripe's invoice fee (0.4%). The combined fee is 3.3% plus $.30 per transaction.

Funl will attempt to collect the ticket price (multiplied by the number of tickets) for each individual Bid Winner.

If Funl's first attempt at collecting payment from a Bid Winner(s) is unsuccessful, Funl will attempt 2 additional payment requests from the Bid Winner(s) during the 48 hours following a Funl closing. If Funl is unable to collect payment, the Funl Creator can offer the ticket(s) to the next highest bidder(s) outside the Bid Winners.

You must have a card-on-file in your account in order to create a Funl.

Funl's 10% service fee, 10% concierge fee (if applicable), and all Stripe fees (3.3% plus $.30 per transaction) will be paid first by the amount Funl collects from Bid Winners. If there is not sufficient funds collected from Bid Winners, your card-on-file will be auto-charged for remaining amount.

If the card-on-file fails, or does not have sufficient funds, Funl Creators will have 48 hours to fully pay for their Funl and Concierge fee if applicable.

The breakdown of the $2,336 total is:

10% Funl Fee = $1,000
10% Concierge Fee (if applicable) = $1,000
3.3% plus $.30 per transaction Stripe fees = $336
- 2.9% Stripe fee = $290
- 0.4% Stripe Invoice fee = $40
- $.30 per transaction x 20 tickets = $6

The first $1,180 collected from Bid Winners will pay for the 10% Funl fee and 10% Concierge fee (if applicable). If only $900 is able to be collected from Bid Winners, the Funl Creator's card-on-file will be charged the remaining $100.

If a Funl Creator fails to pay Funl's fees plus Stripe's fees, their Funl account will be under review and may result in termination.

All sales are final. There are no refunds.

You may cancel a Funl before the Funl Closing date/time. If you cancel 3 Funls before the Funl's Closing date/time, your account and access to the site will be under review and may result in termination.

Funl's allowed auction is a modified Reserve Auction with a Hidden Minimum Price.

All-Pay auctions are not allowed on Funl. An all-pay auction is an auction in which everyone submits a bid but both the losers and the winners pay their submitted bids. If a Funl Creator attempts an All-Pay auction in their Funl, the Funl will be reviewed and may result in that Funl's termination.

For example, you have a Funl for a 100 ticket concert. In order to try and drive the bid price up you offer the highest bidder will receive an autographed guitar from you. This would not be allowed. Instead, you could have a Funl for the 100 tickets and then offer a second Funl for 1 ticket which would be the winner of the autographed guitar.

Any other auction forms are not allowed on Funl.

The spirit of Funl is giving all Bid Winners the same experience amongst themselves.

The spirit of Funl is giving our users the opportunity to bid on the experience described on the Funl event page they're bidding on; not bid on something they hope to receive.

You are allowed to offer a random gift to all bidders. For example, one lucky bidder will be chosen and will attend the event for free; or one lucky bidder will be chosen to win a special item.

Funl Creators are not allowed to bid in their own Funls. Funl Creators are not allowed to employ or encourage anyone or any technology to bid in their Funl. If this is reported to Funl, we will review the bids for authenticity. If the bids are not able to be authenticated your Funl account will be put under review and may be terminated.

Funl's auction system employs a 5-minute Funl Closing time extension to prevent bid snipers and bid sniping technology. During the last 5 minutes of an open Funl, 5 minutes is added to the Funl Closing time if:

a user's bid places them in the Bid Winners
a current Bid Winner modifies their bid in any way (amount or number of tickets)
a current Bid Winner cancels their bid

Funl Creators will be able to view an individual bidder's username and bid history in that particular Funl.

Funl Creators will not be able to view or have access to bidder's names, emails, phone numbers, or contact information of any kind.

If a Funl Bidder files a dispute with their credit/debit card company and wins the dispute, Funl Creators will refund Funl 90% of the disputed amount.

We will treat your information with respect. By opting in upon signup, you agree that we may process your information in accordance with these terms.

We use MailChimp as our marketing automation platform. By entering your email on our website, you acknowledge that the information you provide will be transferred to MailChimp for processing in accordance with their Privacy Policy and Terms.
